The Philadelphia’s District Attorney’s Office announced on Tuesday that it would not be pressing charges against police officer Angel Vasquez, who was involved in a deadly shootout in the Germantown section of the city in August.

An investigation by the DA's Office into the incident found that Vasquez, who was executing a search warrant with the SWAT unit, had reason to believe his life was in danger when he opened fire, killing 59-year-old Ricardo Giddings.

“We have concluded that the officer reasonably believed he was in danger of death or serious bodily injury. The officer was, therefore, legally justified in using deadly force and in this circumstance no criminal charges are warranted,” the DA’s Office said in a press release.

During the Aug. 6 incident, Giddings used his semi-automatic pistol to fire four rounds at the police officers as they entered his home, according to the investigation’s findings.

One officer, Jaison Potts, was critically wounded after being hit in the face. Vasquez shot Giddings in response to coming under fire.

The investigation determined that the officers had knocked and announced their presence “multiple times” before entering.
