"Arbitrary and Unfair" Immigration Enforcement

"Consider what happens when we have an immigration system… that is unenforced and unenforceable. To look "tough", what little enforcement we have ends up being arbitrary and unfair."

 

This statement was part of a strong plea to Congress urging it to pass immigration reform back in June 2007.  The pleader was then Arizona governor Janet Napolitano, who became two years later the Obama administration's current Secretary of Homeland Security. 

Now under Secretary Napolitano, Immigration and Customs Enforcement-ICE continued audits of employment against a clothing maker in downtown Los Angeles, which triggered the announcement a month ago that American Apparel would dismiss 1,500 factory workers.  This investigation, which started under the Bush administration in 2007, had revealed irregularities in the identity documents presented by workers at the time of being hired.

The iconic 'American Apparel' is such for many reasons, both good and questionable, yet it did something many employers of "unauthorized immigrants" don't, pay decent living wages (between 26 and 65 percent above the federal minimum), deduct taxes, and grant health benefits to its workers many of whom had served the company for a decade or more.

This episode of 'looking tough' despite its civility of not raiding hapless workers arbitrarily still is essentially unfair.  Immigration reform is still not in place, and until such time the Obama administration's approach should not simply be to enforce that which is unfair.

Secretary Napolitano you stated in 2007 "our current system is a disaster." Why then are you still wielding this broken weapon?  Two years ago you had the presence of mind to question Congress whether this was "a fair immigration system", "a wise immigration policy", or "good homeland security".

Will you now continue to add to the devastation?
