The PENNDOT driver’s license dilemma has finally reached its end stage. As a result of   Pennsylvania state laws requiring Pennsylvania drivers to be legally present in the U.S., which means with USCIS authorization, PENNDOT has now sent out a batch of final letters to those whose licenses appear to not be valid based on incorrect information in the PENNDOT system or not valid because they were issued to individuals who have only an ITIN, not a social security number.

The buzz in the community now centers around one question and one question only: what should you do if have received this letter and have only an ITIN number because you are in the U.S. illegally? Should you ignore the letter that says if you don’t respond that your license will be rescinded? Should you appear at PENNDOT to file an appeal, knowing that you are not eligible for a license?

The answer: only challenge the license rescission if you know that it is in error and you are legally in the U.S. ( remember, some people with ITINS who lack social security numbers are legally in the U.S., in a status that permits them to legally obtain a Pennsylvania driver’s license).

This answer raises other questions and concerns such as what will happen if you do not appeal because you know that you cannot win this battle due to your lack of lawful immigration status? PENNDOT will send you a letter rescinding your license, most probably asking you to return it to them. Your driving privileges will be cancelled until you are later (hopefully) legally in the U.S. and able to repair your immigration status.

What will happen if you keep driving because you need to get to work in order to support your family, despite the fact that you know that you now have a cancelled license? If you are stopped by any law enforcement officer you can be taken into custody if it is determined that you are breaking the laws of this state (which driving without a license is).

What is the solution? There is none, that is, until and unless amnesty ever comes.
