For those individuals with Temporary Protected Status (TPS status) from Honduras and Nicaragua, it is now time to re-register. The American Immigration Lawyers Association urges all who are eligible not to delay in filing and to be sure to double check the Lock Box Address to which the forms must be sent. AILA has provided the following instructions to all those involved in the process:

As we are in TPS re-registration season for Hondurans and Nicaraguans (before December 1, 2008) and Salvadorans (before December 30, 2008), the Vermont Service Center (VSC) is expecting a large volume of filings and filing early is encouraged. NOTE: TPS is not filed directly with VSC. Please verify the LOCK BOX address before filing.

A few pointers:

  • If an applicant's TPS and I-765 remains pending from last year, TPS applicants will still need to re-register for this year. Pending applications will not be assigned to the new re-registration period.
  • All filings will be submitted to the lock box and will be scanned in. Please thoroughly review Table 3 on the Federal Register Notice and the filing instructions on the Form I-821 and in the Federal Register.
  • For TPS granted by IJ's, please encourage the IJ to clearly indicate "TPS Granted" and not simply "Administratively Closed for TPS." The VSC interprets "Administratively Closed" to mean the removal proceedings are closed and TPS is not necessarily granted. You may wish to see if the IJ can amend a prior order that stated "Administratively Closed" to "TPS granted."
  • To facilitate the processing of the TPS registration and EADs, provide proof of initial or earlier registrations for TPS.

Now the big question: How do you go about registering or re-registering for TPS status?

In order to re-register for TPS, applicants should first confirm the deadline for registering. The deadline for Honduras is December 1, 2008 and for El Salvador it is December 30, 2008. Next, visit the USCIS website at www.uscis.gov . Click on the link for “Immigration Forms” and scroll down to “Form I-821, Application for Temporary Protected Status” and then click on the link. This link will provide you with specific information for re-registering (or registering for the first time)   according to your country of origin. To avoid causing any unnecessary delays with your application or missing the deadline, always remember to take the time to read all the instructions to ensure that

  1. 1. all of the proper forms and documentation are filed and
  2. 2. to ensure that you file your application at the correct Lock Box address. Finally, please keep a copy of your application—just in case USCIS misplaces it.

The next question: What exactly is this Lock Box?

A Lock Box is a specially designated box that USCIS has assigned to perform secretarial type functions—receiving large volumes of documents. The Lock Box conducts a preliminary review of the documents to confirm that all the proper documentation has been submitted. If anything is missing, the Lock Box will either reject and return the filing to the applicant or will issue a “Request for Evidence” for the missing information or documentation. Once the Lock Box has completed the preliminary review, the documents are then forwarded to the USCIS Service Center or Field Office having jurisdiction over the case for further review and processing.

The Lock Box address for TPS applicants depends on their country of origin.

One final hint: do, whenever possible, file your case by Federal Express in order to always have proof of timely receipt and delivery.
