The Justice Department is just now recognizing that discrimination comes in more forms than race, according to the New York Times this morning.

For 11 years, racial profiling was a banned practice for federal investigators, except in cases of national security. I.C.E. and the F.B.I. were permitted to use religion, gender, sexual orientation and country of origin as justification for investigation.

The decision could affect thousands of Muslims, Hindus, Mexican-Americans, LGBTQ individuals and others who have been identified and persecuted because of where they come from, what faith they practice or who they are. That is, if the ban is enforced and profiling prosecuted. 

The decision will not apply to states and localities, where controversial stop-and-frisk laws enable all forms of profiling. Last month, the Justice Department released a study that statistically proved racial profiling of Latinos in traffic stops.

Federal investigators may still be able to excuse profiling in cases of national security.
