If you are an immigrant and have been legally residing in the country for less than five years, you might not be eligible for Medicaid in the state of New Jersey. The state’s Supreme Court ruled that the measure does not violate the right to “equal protection”.
Until 2005, legal immigrants residing in the country for at least five years were not eligible for Medicaid; however, the state government decided to include them in order to control the expenditure of charitable medical centers. Five years later, in 2010, New Jersey again changed its policy on this matter, again excluding a population group made up of over 10,000 residents.
The measure, labeled as unconstitutional by the affected groups, has been backed by the state’s Supreme Court on more than one occasion.
The Personal Responsibility and Work Opportunity Reconciliation Act of 1996 allows states to decide on maintaining or eliminating the right of foreign residents to enjoy coverage under Medicaid.
